Welcome to the Theatre Aotearoa website (the Site). The Site is operated and presented to users by the Theatre Aotearoa and AusStage consortium of Australian and New Zealand universities, government agencies, industry organisations and collecting institutions.

Theatre Aotearoa is committed to collecting and sharing information about live performance in New Zealand as an ongoing and collaborative endeavour. Theatre Aotearoa and AusStage users come from New Zealand, Australia and all around the world.

If you have used the resources of Theatre Aotearoa, we remind you to acknowledge Theatre Aotearoa's copyright as you would any other secondary source. If you download this data to create your own visualisations or graphics we request that you clearly note that the data has been harvested from Theatre Aotearoa. For traditional publications, a sample acknowledgement is: This article/book/chapter/entry acknowledges Theatre Aotearoa: © Theatre Aotearoa and contributors, CC BY-NC-SA 4.0. These Terms of Use apply to all users of the Site, including users who are not Registered Users. Please read the Terms of Use carefully before using the Site.

1. Definitions

"The Site" means the publicly viewable web site at https://theatreaotearoa.ausstage.edu.au and related web Services.

"Services" means the open web services accessible online in the theatreaotearoa.ausstage.edu.au domain.

"User" means a person who access the Site or related Web Services.

"Registered User" means a person who has registered to use the Site.

"Content" means information contributed by Users and collected by Theatre Aotearoa, in a variety of formats (text, pictures, sound and moving images), including records, comments and tags.

"Content Licence" means the Licence Agreement under which Users provide copyright Content to Theatre Aotearoa for use on the Site.

"User Licence" means the Licence Agreement (Creative Commons: Attribution, Non-Commercial, Share Alike) under which Theatre Aotearoa provides copyright Content to Users for their own use.

"Terms of Use" means these terms of use, together with the Theatre Aotearoa Privacy Policy, and other terms, conditions, notices and disclaimers displayed on the Site.

"Us", "we" or "our" means Theatre Aotearoa and/or its related bodies corporate.

2. Access

By accessing or using the Site you signify your agreement to:

1. these Terms of Use;
2. the Theatre Aotearoa Privacy Policy and statements on Cultural Advice and Accessibility;
3. the Theatre Aotearoa User Licence; and
4. other terms, conditions, notices and disclaimers displayed on the Site.

You also agree that, in your use of the Site you will comply with all applicable local, national, and international laws and regulations. If you do not agree to these Terms of Use, you may not use the Site.

3. Copyright

All Content in Theatre Aotearoa is copyright. If you use information from Theatre Aotearoa you must acknowledge copyright and our licence terms: © Theatre Aotearoa and contributors, CC BY-NC-SA 4.0.  Advice on citing records in Theatre Aotearoa is provided on the citation page.

Content displayed on the Site and/or accessed through Services is licensed to Users under the User Licence, a version of the Creative Commons: Attribution, Non-Commercial, Share Alike licence.

Under the User Licence, you are free to copy, distribute, display and perform the work and to make derivative works under the following conditions:

• Attribution: You must give the original author credit.
• Non-Commerical: You must not use this work for commercial purposes.
• Share Alike: If you alter, transform, or build upon this work, you may distribute the resulting work only under a license identicial to this one.

With the understanding that:

• Waiver: Any of the above conditions can be waived if you get permission from the copyright holder. For example, Theatre Aotearoa grants artists and companies permission to use the information that Theatre Aotearoa collects about their own work for commercial purposes.
• Public Domain: Where the work or any of its elements is in the public domain under applicable law, that status is in no way affected by the licence.
• Other Rights: In no way are any of the following rights affected by the licence - your fair dealing or fair use rights, or other applicable copyright exceptions and limitations; the author's moral rights; rights other persons may have either in the work itself or in how the work is used, such as publicity or privacy rights.
• Notice: For any resuse or distribution, you must make clear to others the licence terms of this work.

4. Registration

To contribute Content to the Site, you must complete the appropriate registration form, and agree to license your contributions to Theatre Aotearoa under the Content Licence. When registering with Theatre Aotearoa, you agree to provide accurate, complete and up-to-date information about yourself. You also agree to inform Theatre Aotearoa of any changes to your personal information.

You are responsible for the activity that occurs on your registration, and you must keep your password secure. You may not use another person's registration without permission. You must notify Theatre Aotearoa immediately of any unauthorised use of your registration.

5. Content

Content contributed by Registered Users is licensed to Theatre Aotearoa under the Content Licence. The Content Licence is provided to Users at registration. Registered Users are required to agree to the Content Licence as a condition of registration. The Content Licence is a version of the Creative Commons: Attribution, Non-Commercial, Share Alike, the same licence under which Theatre Aotearoa provides Content to Users.

Theatre Aotearoa allows Registered Users to post comments and attach tags to records. On successfully completing a program of training in data entry protocols and procedures, Theatre Aotearoa also allows Registered Users to add, edit and copy records.

Registered Users are advised that all Content, including records, comments and tags, is subject to editorial review. Theatre Aotearoa reserves the right to assess the quality of and to moderate, and at its sole discretion, to accept, modify or reject Content at any time and on any basis.

Registered Users are responsible for their own Content and the consequences of publishing it on the Site. Registered Users must not submit Content that is (a) defamatory or otherwise unlawful, or violating any laws regarding harassment, discrimination, racial vilification, privacy or contempt; (b) abusive, offensive or obscene; (c) deliberate provocation of other Site Users; (d) compromising your privacy, the privacy of other Users or Theatre Aotearoa staff, or containing inappropriate personal information; (e) an infringement of intellectual property rights or copyright; (f) intentionally false or misleading; (g) seeking to endorse or promote commercial products, services or activities; or (h) a posting made on behalf of a User whose registration has been terminated or suspended.

The opinions expressed in Content are not necessarily those of Theatre Aotearoa or its partners. While care is taken to ensure that details entered into Theatre Aotearoa are correct, complete and up-to-date, Theatre Aotearoa does not warrant the accuracy of any information published on the Site andno responsibility will be taken for errors or omissions in data. Users are advised that the dataset is not yet comprehensive.

6. Account Termination

Theatre Aotearoa will terminate a User's registration if Theatre Aotearoa, in its absolute discretion, determines that the User has contravened these Terms of Use or any licence entered into by that User in respect of Site and/or its Content.

7. Variations to the Site

Theatre Aotearoa may change the information available on this Site without notice. Theatre Aotearoa may also change the conditions of access to the Site and its Services.

Theatre Aotearoa may change these Terms of Use and other policies at any time. Notice of such changes will be publicised on the Site not less than 7 days prior to their implementation. If you do not agree to any changes, you should give notice to cancel your registration within the 7 day period. Use of the Site after the changes become effective will be taken as acceptance of the changes.

8. Service Provision

There will be times when the Site and its Services are unavailable due to maintenance, emergency repairs, failure of telecommunications links and other events beyond our control, therefore we cannot guarantee that you will have uninterrupted access to the Site or its Content.

9. Links to Other Sites

This site includes links to other websites, as a convenience to users. Each linked website has its owns terms and conditions of use, and you must ensure that you comply with them.

In providing links to other websites, Theatre Aotearoa does not endorse or make any representation or warranty regarding the products, services or information available via any linked website, or in respect of the owner or operator of that website.

Theatre Aotearoa is not responsible for any loss or damage arising from your use of or access to any linked website.

10. External Content from Other Sites

Theatre Aotearoa includes content from other sites, including Google Maps and Picture Australia. Theatre Aotearoa will indicate to users when external content is presented on the site. Users are advised that their use of this content is subject to the external site's terms of use.

11. Privacy, Cultural Advice and Accessibility

Theatre Aotearoa advises Users of its obligations under the Privacy Act (1998) and its operation in accordance with the Information Privacy Principles. The Theatre Aotearoa Privacy Policy forms part of these Terms of Use.

Theatre Aotearoa advises Users of its commitment to respecting the cultures of first nations peoples, and to ensuring that the Site is accessible to everyone. The Theatre Aotearoa statements on Cultural Advice and Accessibility form part of these Terms of Use.

12. Use of AusStage Branding

You are not entitled to copy, modify, distribute or use any of Theatre Aotearoa's trademarks, logos or branding without prior permission.

13. Applicable Law

These Terms of Use shall be construed in accordance with and governed by the laws of New Zealand and Australia. You consent to the exclusive jurisdiction of the courts in New Zealand to determine any matter or dispute which arises under the Terms of Use.
